EBA Guidelines and RTS related to PDS2

The European Banking Authority (EBA) is elaborating guidelines and regulatory technical standards (RTS). See below for an overview and the status of these guidelines and RTS.

Adoption by the European Commission

The European Commission must approve all guidelines and RTS. The RTS enter into force when they are published by the European Commission or at a later date if specified in the RTS.

The guidelines enter into force in a Member State following approval by the national competent authority. DNB is the national competent authority for the Netherlands.

Implementation in the Netherlands

DNB has determined that the guidelines will come into effect in the Netherlands when the Dutch PSD2 legislative proposal enters into force, although it is not yet clear when that will be.

Payment service providers must comply with the RTS as soon as they are published by the European commission or later if specified in the RTS, which could therefore be before they are implemented in Dutch law.

Several of the guidelines and RTS are not yet definitive. The EBA will issue an Opinion containing recommendations to supervisors and payment service providers on how to interpret each guideline or RTS.
