Power to request information under the Act on the Supervision of Trust Offices

On the basis of Section 9 of the Wet toezicht trustkantoren or Wtt [Act on the Supervision of Trust Offices], De Nederlandsche Bank (DNB) has the general power to request information. The stipulations of Section 5.2 of the Algemene wet bestuursrecht or Awb [General Administrative Law Act] largely apply to this power to request information.

Who may request information?

Information may be requested by DNB and by the persons charged by DNB with the performance of the duties and powers it has pursuant to the Wtt. The supervisors will carry IDs issued by DNB and will show these upon request.

Obligation to cooperate

For the actual implementation of the supervisors´ power to request information, Section 5:20 of the Awb includes an obligation to cooperate. Within a set reasonable period, everybody is obliged to cooperate fully with the supervisor, who may request so in all reason. The obligation to cooperate only applies if it relates to the performance of the (legally assigned) power of supervision.
