Register pension funds
Contents of the register
Pursuant to Section 112 of the Pension Act (Pensioenwet) and Section 107 of the Mandatory Occupational Pension Scheme Act (Wet verplichte beroepspensioenregeling), a company pension fund or industry-wide pension fund must notify DNB six weeks before the proposed date of establishment. Within three months after it has been established, the company pension fund or industry-wide pension fund must notify its establishment to DNB, with a request for registration. Subsequently, the pension fund is entered in this public register. Contrary to other types of financial undertakings, pension funds are not subject to an authorisation requirement, with the exception of general pension funds (algemeen pensioenfonds, APF).
Pursuant to Section 112a of the Pension Act, different rules apply to general pension funds. It is prohibited to pursue the business of a general pension fund in the Netherlands without an authorisation. A general pension fund may only be registered after DNB has issued it with an authorisation.
