Cross-border services

A payment institution may, from the Netherlands, offer services in another Member State without having any establishment in that Member State. This is known as the provision of cross-border services. A notification to DNB of the payment institution’s intention to provide cross-border services must meet the requirements set in section 42a(a) of the Decree on Market Access of Financial Undertakings (Besluit Markttoegang financiële ondernemingen) and must be submitted using the notification form.

Where the provision of information to DNB with respect to the notification procedure is concerned, a Q&A has been prepared. Once DNB has informed the institution that the notification has been sent to the host supervisory authority, the payment institution may start offering services in the receiving Member State. Hence, the payment institution does not have to wait until the notification procedure has been rounded off by entries in the relevant registers.

DNB may at any time ask a payment institution for further information and/or an explanation of the data submitted.
