DNB publishes Good Practices Wtt 2018

De Nederlandsche Bank (DNB) has released the final version of its Good Practices Wtt 2018. This document offers trust offices practical guidance on complying with the Act on the Supervision of Trust Offices 2018 (Wet toezicht trustkantoren 2018 – Wtt 2018). The Good Practices reflect insights from sector discussions and a public consultation that concluded on 6 February 2025. DNB carefully reviewed all feedback received and incorporated relevant suggestions into the final publication. A separate feedback statement outlines how the consultation responses were addressed.

By publishing the Good Practices Wtt 2018, DNB aims to provide guidance to the trust sector while preserving room for individual interpretation of open standards. This approach acknowledges the sector’s diversity and the importance of aligning with existing laws and regulations. DNB also notes that the Anti-Money Laundering and Anti-Terrorist Financing Implementing Act has recently been put up for consultation. Together with the forthcoming Anti-Money Laundering Regulation (AMLR) and the establishment of the new Anti-Money Laundering Authority (AMLA), this legislative proposal signals significant changes to the regulatory framework for trust offices. AMLA will be tasked with issuing regulations and guidelines on various topics in the near future.

In light of these anticipated changes, DNB has deliberately chosen to limit the level of detail in this policy document, including the number of sector- or institution-specific examples.

Please note that the Good Practices are non-binding. Trust offices may choose alternative methods to meet their obligations, as long as they can demonstrate compliance with applicable laws and regulations.
