If you do not hold a licence from the European Central Bank (ECB), you are not permitted to pursue the business of a bank in the Netherlands pursuant to Section 2:11 of the Financial Supervision Act (Wet op het financieel toezicht - Wft).
We pursue a policy of active enforcement and perform checks at regular intervals. If you pursue the business of a bank without a licence or statutory exception, DNB can take several enforcement measures, including issuing cease and desist orders and imposing administrative fines.
Non-compliance with the Financial Supervision Act constitutes a criminal offence under the Economic Offences Act, which we can report to the public prosecutor's office.
There are two new regulatory developments of relevance to banks regarding their crypto asset exposures. Firstly, the Capital Requirements Regulation 3 (CRR3) includes a transitional regime on banks’ direct crypto asset exposures.

The final texts of the Capital Requirements Regulation 3 (CRR3) and the Capital Requirements Delegation 6 (CRD6) were published on 19 June 2024. With this new banking package, the final Basel 3 reforms are implemented in the European Union.

On June 6th, DNB started the public consultation of the 2024 amendment round of the Deposit Guarantee Scheme (DGS) Policy Rules for banks. Parties are requested to submit responses to the consultation to DNB by 19 July at the latest.
